  1. Eligibility

The brightwheel iPad Giveaway (the “Giveaway”) is open to individuals who are legal residents of the state of Kansas in the United States and are 18 years of age or older at the time of entry, and who submit an entry on behalf of a preschool or childcare program (each, an “Entrant”). By entering, the individual affirms that they are authorized to submit the entry on behalf of the school or program. Limit one (1) entry per school or program; duplicate entries will be disqualified. Entry into the Giveaway constitutes acceptance of these Terms and Conditions (the “Rules”). Employees of the Sponsor, its affiliates, contractors, agencies, and anyone involved in the development or execution of this Giveaway—as well as their immediate family members (spouse, parent, child, sibling)—are not eligible to enter. Void where prohibited.

  1. Giveaway Period

The Giveaway starts on 12/2/2025 12:00 AM PDT and ends on 1/31/2026 11:59 PM PDT (the “Giveaway Period”). Late entries will not be considered. All dates are subject to change. Sponsor’s server is the official clock for this Giveaway. All entries submitted during the Giveaway Period which are valid as of the drawing date will be eligible for the Giveaway.

3.Participation Requirements

To participate, Entrants must:

  • Successfully sign up and pay for brightwheel premium subscription by January 31, 2026 11:59 pm PDT; and
  • Be a preschool/childcare program with capacity of 10+ students, located in the state of Kansas. 

Only one (1) entry is permitted per program. Duplicate entries will be disqualified.

Participants may also enter via our Alternate Method of Entry (“AMOE”) without purchasing a brightwheel subscription. To enter via our AMOE, you must mail a 3×5 note card in an envelope to the address listed in this section below with all of the following information legibly handwritten in black or blue ink: a) full name, b) email address, c) address, d) phone number, and e) the name of your preschool or childcare program. AMOE entries will be drawn on an equal basis as sign up entries. 

AMOE entries must be postmarked by January 31, 2025 and received by February 4, 2025. Mail entries to:

Sponsor will not confirm receipt of any AMOE entries. All entries become the property of the Sponsor and will not be returned. Sponsor is not responsible for entries that are lost, late, misdirected, illegible, damaged, or undeliverable due to mail delays, system errors, or technical failures of any kind.

In case of a dispute over who submitted an entry, it will be deemed submitted by the authorized account holder of the email address listed on the entry. The authorized account holder is the natural person assigned that email by the applicable service provider.

Any false information provided in connection with the Giveaway, or any attempt to exceed the entry limit (including use of multiple email addresses or identities), may result in disqualification at Sponsor’s sole discretion.

4.Drawing / Odds

Sponsor’s decisions are based on their sole discretion and interpretation of these Rules, and are final and binding. Odds of winning depend on the total number of eligible entries received during the Giveaway Period. 

  1. Giveaway prize 

One (1) giveaway winner will be randomly selected (the “Giveaway Winner”) on February 5, 2026 (the “Drawing Date”) and notified on February 6, 2026, via email.The prize is one Apple iPad (the “Prize”). The total value of the prize is $349 USD. The prize is non-transferable and cannot be exchanged for cash or other products/services. Apple is not a sponsor of this Giveaway, and no association or endorsement by Apple is implied.

  1. Contacting the Winner.

The Giveaway Winner will be contacted via email. The Giveaway Winner must respond within 48 hours of notification to claim the Prize. If there is no response, an alternate winner will be selected.

  1. Prize Restrictions

The Giveaway Winner must comply with all applicable laws and these Rules. Any taxes or expenses not expressly included with the Prize are the Giveaway Winner’s sole responsibility. Prizes are non-transferable and may not be substituted or redeemed for cash, except at Sponsor’s sole discretion.

  1. Copyrights and Intellectual Property

By entering, you confirm that any comments or content you submit are your original work and don’t violate anyone else’s rights. You give Sponsor permission to use, share, and publish your submissions for promotional or other lawful purposes, in any media, without additional approval or payment.

  1. Marketing Communications

By entering, you agree that Sponsor may use your contact information, including email address and phone number, to send you marketing communications, surveys, and promotional offers, subject to applicable privacy laws. You may opt out at any time.

  1. Right to Cancel, Modify or Disqualify

Sponsor may cancel, suspend, or modify the Giveaway if it cannot run as planned due to technical issues, fraud, or other disruptions. Submissions with inappropriate, offensive, or irrelevant content will be disqualified. Sponsor may also disqualify any entrant for violating the rules, tampering, fraud, or unsportsmanlike conduct. Automated entries are not allowed and will be disqualified.

  1. General Terms

All taxes and expenses not expressly covered by the Prize are the sole responsibility of the Giveaway Winner. Entrants agree to be bound by these Rules and the decisions of the Sponsor, which are final. Entrants release and hold harmless the Sponsor, its affiliates, agencies, and their respective officers, employees, and representatives (“Releasees”) from any and all liability, losses, or damages arising from participation or prize use, including personal injury, property damage, or rights of publicity/privacy.

By accepting the Prize, the Giveaway Winner consents to the use of their name, image, and likeness for promotional purposes by the Sponsor in any media worldwide without additional compensation, unless prohibited by law.

Releasees are not liable for: (a) technical errors of any kind, including malfunctions or unauthorized access; (b) lost, delayed, or corrupted entries; or (c) events that disrupt or corrupt the promotion. 

  1. Personal Data Protection

Participant information will be used solely for the administration of this giveaway and for marketing communications from brightwheel, and will not be shared with third parties for other purposes without consent.

  1. Arbitration and Applicable Law

Except where prohibited, Entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or any prize awarded, or the determination of the Giveaway Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to these Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, indirect, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of Entrant and/or Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine, and all proceedings shall take place in the State of California. Entrant waives any objection to the choice of forum on the grounds of inconvenient forum.
